PROPOSED IMPOSITION OF CIVIL PENALTY - $25,000 This is to inform the Connission that a Notice of Violation and Proposed

Imposition of Civil' Penalty in the amount of $25,000 will be issued on or about July 16, 1990 to Northeast Nuclear Energy Company. This action is based on the-licensee's-failure to meet a technical specification limiting condition for.
1 operations' involving the main steam line high flow set point as well as the failure to. perform an adequate monthly surveillance test of the gas turbine L
' generator. Though the safety significance of each item was limited, the L
violation was categorized at a Severity Level III due to the duration of the deficiencies and the prior opportunities to identify and correct them. The 4
proposed civil penalty was mitigated by 100% due to the licensees. good past

performance. However, that mitigation was offset by 50% escalation of the base civil penalty for prior notice. No further escalation or mitigation Ll based on.the other factors-is warranted.
- It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:

The State of Connecticut will be notified.
The licensee has thirty days from the date of the Notice in which to respond.
