Dear Senator Cohen:

This responds to your letter of April 20, 1990, to Chairman Kenneth Carr,-

concerning the employment status of Mrs. Sydney Faulkingham with the U.S.

i Nuclear Regulatory Commission (NRC).

As a matter of )olicy, we do not believe-it is appropriate to have employees work for both t1e NRC and a state in areas where wa.)oth regulate.

However, l

NRC senior management did not advise Mrs.- Faulkingham of this view until they became aware of the situation some months after she was given permission by her immediate supervisor. Therefore, I have made a one-time exception to this i

policy to allow her to continue her dual employment. We have advised Mrs. Faulkingham that she may continue her employment with the NRC under the conditions outlined in the enclosed letter.

As a matter of policy, we do not believe it is appropriate to have employees work for both tie NRC and a state in areas where we both regulate.
