. leak rate testing as prescribed in 10 CFR 50.54(o) and Appendix 0 to 10 CFR Part 50. This exemption would be granted to the Long Island Lighting Company (LILCO),thelicenseefortheShorchemNuclearPowerStation(SNPS),locatedin Suffolk County, New York.

ENVIRONMENTAL ASSESSMENT Identification of Proposed Action:

The proposed action would grant an exemption from the requirements of 10 1

CFR Part 50, Appendix J Sections III.D.1, D.2, and D 3 to perform periodic containment leak rate testing, as requested by the licensee in its letter dated December 8, 1989. This exemption is the proposed action being considered by the Comission, j

The Need for the Proposed Action:

The licensee's letter of December 8, 1989 provided the following justification for an exemption from the reouirements of Appendix J to 10 CFR Part 50 to perform periodic leak rate testing of the containment. Continuing to conduct unnecessary Appendix J containment leak rate testing would result in undue hardship and costs that are not necessary for public safety. The request for an exemption from Appendix J containment leak rate testing represents an appropriate ordering of priorities and a prudent allocation of resources.

. Environmental Impact of the Proposed Action:

The proposed exemption does not affect the manner of current facility operation, or the risk of facility accidents.

(Shorehamiscurrentlyshutdown anddefueled,andthereactorvesselinternalsarebeingremoved.) The possibility of environmental impact from this exerption is extremely remote.

The subject contairment leak rate tests are conducted during shutdown periods prior to resumption of power operations, usually following refueling. LILCO is prevented, by agreement with the State of New York, from operating Shoreham.

However, should conditions change, the staff requires that containment barriers be tested and demonstrated operable prior to refueling the reactor.

The proposed exemption would not authorize construction or operation, would not authorize a change in licensed activities, nor effect changes in the permitted types or amounts of radiological effluents.

Post-accident radiological releases will not differ from those determined previously, and the proposed

exemption does not otherwise affect facility radiological effluents or occupational expcsures. With regard to potential ron-radiological impacts, the proposed exesiption does not affect plant non-radiological effluents and has no other environmental impact. Therefore, the Commission concludes there are no measurable radiological or non-radiological environmental impacts associated with the proposed exemption.

Alternative to the Proposed Action:

Since the Connission concluded that there is no measurable environmental impacts associated with the proposed exemption, alternatives with equal or greater environmental impacts need not be evaluated. The principal alternative to the exemption would be to require the licensee to continue conducting containment leak rate tests.

Such actions would not enhance the protection of the environment or the public health and safety, i

M Alternative Use of Resources:

This action does not involve the use of any resources not previously considered in the Final Environmental Statement for the Shoreham Nuclear Power Station.

Agencies and Persons Consulted:

The NRC staff reviewed the licensee's request and did not consult other agencies or persons.

FINDING OF NO SIGNIFICANT IMPACT I

The Comission has determined not to prepare an environmental impact statement for the proposed exemption. Based on the foregoing environmental assessment, the Comission concludes that the proposed action will not have a significant effect on the quality of the human environment.
