Dear Judge Rosenthal*
This letter is to advise you of the Comission's decision regarding extension of Contract No. NRC-34-89-347 under which you assumed responsibilities for certain investigations begun by the former Office of Inspector and Auditor involving the Office of Investigations.
In your most recent Letter Report under the terms of the contract you noted that further investigation of the remaining matter before you would be-pointless until any tapes are received from Mr. Comley pursuant to the subpoena duces tecum o
issued to him by the Comission. Consequently, you saw no reason to extend the contract which expires at the end of December.
We concur in your view that under the circumstances there is no need to extend this contract. As you know, you were asked to assume these 1
l responsibilities at a time when the Office of Inspector General had not yet been established for the Comission and when no permanent inspector General was in place. Mr. Williams, the Inspector General for NRC, has now assumed his duties at the NRC.
I have discussed the status of this matter with him, and.we have concluded that in the event that tapes are received, the Inspector General will assume responsibility for determining what additional La investigative actions are appropriate.
On-behalf of the Comission, I want to take this opportunity to thank you for your willingness to undertake this assignment on.such short notice and
