REQUEST FOR INVESTIGATION As you are aware, before the Office of Inspector General was establi',hed and you took office, the Comission asked Judge Alan Rosenthal to a;sume responsibility for.certain investigations involving the Office of Investigations which'had been initiated by the Office of Inspector and~
Auditor, the. predecessor organization of the Office of Inspector 3eneral.
Judge Rosenthal's contract with the Comission to conduct these
' investigations expires at-the end of the month.
Currently, no ratters are pending before him except for further exploration of the' relationship between Mr. Stephen Comley and Mr. Roger Fortuna if Mr. Comley honors the rubpoena duces tecum outstanding against him for tapes of any conversations between the two individuals. Because the Office of Insactor General is fully operational, it appears appropriate that responsiaility for further action in this matter should be undertaken by your office.
Therefore, the Comission requests that you undertake this investigation to determine the significance of any tapes received in response to the subpoena and pursue any reasonable line of investigation suggested by them.
I would encourage-you to contact Mr. Rosenthal for any assistance he may be able to provide you in-addressing this matter.
