SUBJECT:
COMPONENT REMOVAL ACTIVITIES By letter dated May 22, 1990 you informed the NRC that Public Service Company of Colorado (PSC) (intended to proceed with the removal of certain components from Fort St. Vrain FSV)under10CFR50.59. You requested that we respond by June 22, 1990 if we had any questions with respect to the May 22, 1990 proposal.
We have discussed the concerns we have with your plans with Mr. Mike Holmes of your staff.
In response to your proposed component removal, we would like to reiterate the NRC position from our confirmatory shutdown order of May 7 1990 that stated:
"this confirmatory order in no way relieves the licensee of the terms and conditions of the operating license." The confirmatory order is consistent with your letter of October 24, 1989 in which you stated that "PSC will continue J
to comply with applicable license conditions and regulatory requirements during l
defueling, unless and until relief is requested by PSC and approved by the NRC."
Our preliminary evaluation of your proposed action is that items #1, #3, and
- 4 [the removal and disposal of the spare control rod drive CR absorber strings andcrackedsteamgenerator]wouldnotneedNRCapproval. The removal and

disposal of spare components and damaged equipment that must be. repaired or replaced anyway prior to resuming operations are not actions that may be classified as precluding restart. The other proposed actions presented in your May 22, 1990 letter should be delayed until after a possession-only license is issued to PSC. As we have indicated to your staff, NRC action on your request is anticipated in the near future.
However, we would be pleased to consider any additional information that you might wish to present related to the impact of the other changes.
