I MR. CONTE:
On the 10th of Janut.ry of this year, the Statv of Illinois filed with the Nuclear Pegulatory Comission a request that Illinois be granted regulatory authority over 11-e.(2) material (thorium).
That application in its preapproval period was negotiated by State of Illinois staff and NRC staft over a period of 18 months after Governor Thompson signed Illinois' petition on August of

1988.
I was told a year and h61f ago that processing time, from submittal to filing in the Federal Register, would be 4-5 weeks.
On March 6,1990, two months af ter lilinois had submitted its L
request, Illinois' application was not published in the Federal Register. This was after Mr. Denton had indicated to my staff that the filing was " imminent". On March 6, 1990 representatives j
from the NRC told me the filing would be delayed by two weeks.
We leerned yesterday that it would be delayed even further, possibly ten days.
I tm aware of two letters from Mr. Richard Meserve to Mr. Denton requesting that the hRC slow down the filing of. Illinois' petition. We were given assurances by Mr. Denton that you would not accede to his request.

Following submittal of Illinois' request for an amendment to its Agreement in August of 1988, the hRC staff reviewed the draft regulations included in the i
request and sent comments to the Illinois Department of Nuclear Safety by letter dated August 23, 1989. The delays from August of 1988 to January of 1099 we e due to review arid discussion of the Illinois draft regulations, which, in some respects, were incomplete. The final version of the Illinois regulations on this h.Wter was submitted to the NRC January 10, 1990. Thus, the January 10, 1990 submittal finally completed the Illinois request.

accordance with the procedures specified in Section 274 of the Atomic Energy Act of 1954, as ainended, the statf proceeded with completion of the assessment of the application. This work was given high priority by the staff. The proposed assessment was completed by staff on March 21 and moved to the NRC Offices of General Counsel and Executive Director for Operations where it was given highest priority attention including staff overtime. The assessment will be sent to the Federal Register the week of Herch 26 for publication.
Our February 23, 1990 response to Mr. Richard A. Meserve made clear that NRC in preparing the assessment followed the procedures specified in Section 274 of the Atomic Energy Act of 1954, as amended. NRC staff handled the request with deliberate speed and with due regard to its responsibilities under the Act, 1
