This letter responds to your March 14, 1990 appeal of this Agency's denial of docunents in our March 1,1990 response to FOIA-90-3.
In' response to your appeal, the documents either totally or partially withheld were again reviewed. On the basis of this review it has been determined that an additional docunent should be released. This material identified as Appendix item D-8 is enclosed with this letter. With respect to the balance of denied materials, I affirm the Agency's action in this matter.
The docunents or portions of docunents withheld pursuant to Exemption 5 of the Freedom of Information Act (F0IA) are part of the Commission's predecisional processes.
The purpose of the deliberative injury to the quality of agency decisions." process privile9e is to " prevent NLRB v. Sears. Roebuck & Co.,

Disclosure of these predecisional documents would be t
likely to " stifle honest and frank consnunication within the agency."

With respect to the documents or portions of documents withheld pursuant to Exemptions 6 and 7(C) of the FOIA, the infonnation that continues to be withheld consists of names, dates, and other personal information regarding individuals whose privacy could be affected through release of the information.
This letter represents final Agency action on your March 14, 1990 FOIA appeal.
Judicial review of the denial of documents is available in Federal District Court in the district in which you reside, or have your principal place of business, or in the District of Columbia.
