This letter acknowledges receipt of your Petition of A)ril 6 1990, requesting

.that action be taken with rcgard to the Perry Nuclear >ower flant, Unit 1.

Specifically.-you requested that the U.. S. Nuclear Regulatory Comission order the Cleveland Electric illuminating Company to shut down Perry Unit 1 and that they be issued a Notice of Violation and Civil Penalty for operating in violation of their Technical Specifications since November 1989.

Your Petition has been referred.to me pursuant to 10 CFR I 2.206 of the Comission's regulations. As provided by Section 2.206, we will take action on your request withir. a reasonable time.

However, a preliminary review of the con-cerns in your Petition does not indicate any need to take imediate action as you request because both.of the traveling screens for the Perry Nuclear Power Plant

)

Unit No.1, are currently in service; therefore, the en.ergency service water (ESW system is currently fully operable.

However, as stated by the licensee in its May 16, 1990, letter responding to your Petition, the-traveling screens for the Perry ESW system are parallel, redundant trains and serve' a comon suction bay from which all six ESW pumps from both Units 1 and 2 draw suction supply water.

Each individual-traveling screen has the capacity to. supply sufficient cooling water flow with all Unit I and Unit 2 ESW and fire protection pumps operating. Additionally, in this condition a relatively low approach velocity would exist, thus minimizing the potential for debris accumulation and clogging.

Even if debris were to accumulate and either the screen wash pumps or automatic screen rotstion were to fail for both traveling screens, the traveling screens could be manually washed to prevent screen blockage and 1

potential flowpath impairment. Therefore, I do not believe that the imediate action requested in your Petition is warranted.

PERRY NUCLEAR POWER PLANT UNIT J RECEIPT OF PETITION FOR DIRECTOR'S DECISION UNDER 10 CFR I 2.206 Notice. is hereby.given that a Petition dated April 6,1990, and signed by Ms. Susan L. Histt for Ohio Citizens for Responsible Energy, Inc., has requested that the U. S. Nuclear Regulatory Commission order the Cleveland Electric illuminating Company, Duquesne Light Company, Chio Edison Company, Pennsylvania Power Company and Toledo Edison Company to place the Perry Nuclear Power Plant.

. Unit No.1, in cold shutdown until the Division 2 Emergency Service Water System is made operable and to impose a civil penalty upon the Cleveland Electric illuminating Company.

The Petition was filed pursuant to 10 CFR 5 2.206 of the Comission's regulations and has been referred to the Director of Nuclear Reactor Regulation.

As provided in 10 CFR l 2.206, the Director will take action upon.'the. Petition within a reasonable time.

A copy of the Petition is available for inspection at the Commission's Public Document Room at 2120 L Street, N.W., Washington, D.C.
