Gentlemen:

This letter is in response to the subject Notice of Violation for failing to conduct an audit of the management of the UCC Fundamental Nuclear Material Control Plan within the prescribed time schedule.

Audit assignments had been made by the Nuclear Safeguards Comittee in a timely fashion however, some were assigned to persons outside of the Radiochemicals line organization.

Normal follow-up procedures on the part of the Secretary of the Committee were not effective in accomplishing some audits on schedule.

future audits will be assigned only to employees within the Radiochemical line organization.

The assigments will be made3 Ua part of the departmental project assigment schedule which is. reviewed monthly for status reports to management on all projects.,,This, follow-up procedure will provide management with the necessary control for.. assuring that audits are completed on time.

This new program for audit control was implemented on 10/28/81 and it should prevent a recurrence of this item of non-compliance.

The management audit that was the subject of this Notice of Violation was completed.

Areas examined during this inspection are described in the Office of Inspection and Enforcement Inspection Report which is enclosed with this letter.

Within these areas, the inspection consisted of selective examinations of procedures and representative records, interviews with personnel, measurements made by the inspector, and observations by the inspector.

Within the scope of this inspection, no items of noncompliance were observed.

In accordance with Section 2.790(d) of the NRC's " Rules of Practice," Part 2, Title 10, Code of Federal Regulations, documentation of findings of your control and accounting procedures for safeguarding special nuclear materials and your facility security measures for physical protection are deemed to be commercial or financial information within the meaning of 10 CFR 9.5(a)(4) and shall be subject to disclosure only in accordance with the provisions of 10 CFR 9.12; therefore, except for the report cover sheet, the enclosed inspection report will not be placed in the Public Document Room and will receive limited distribution.

No reply to this letter is required; however, should you have any questions concerning this inspection, we will be pleased to discuss them with you.
