AUG 2 51988 STATE LIAISON OFFICERS AGREEMENT AND NON. AGREEMENT STATES LOW. LEVEL RADI0 ACTIVE WASTE COMPACT DISTRIBUTION Section 5 (e) of the Low-level Radioactive Waste Policy Amendments Act (P.L.99-240) sets forth the milestone requirements for continued access to regional disposal facilities.

To meet the 1990 milestone, States and comoacts must by January 1, 1990 either:

(1)Submitacompletelicense applicationtoNRCoranAgreementState[Section5(e)(1)(C)(1)];or(2)

Submit a certification by_the Governor that the State will provide for storage, management or disposal of its waste after 1992 [Section 5(e)(1)(C)(ii)].

NRC is directed to transmit the certifications to Congress and publish then in the Federal Register [Section 5(e)(1)(E)].

States or compacts which do not meet the milestone face loss of surcharge rebates from DOE as well as denial of access to existing regional disposal facilities.

Enclosed for your information is a copy of a letter from Hugh Thompson, Director of Nuclear Material Safety and Safeguards, to Dr. Teri L. Vierima, Chair of the Midwest Interstate Low-Level Radioactive Waste Comission describing, in general terms, the suggested content of the certifications.

e The NRC staff is currently considering options for implementing this guidance and is interested in your views.

Dear Dr. Vierima:

t This letter is in response to your letter of May 23, 1988 in which you inquired about NRC's plans for dealing with Governor's certifications submitted by states to meet the January 1, 1990 milestone of the Low-Level Radioactive Waste Policy Amendments Act of 1985 (the Act). As you correctly note, the Act directs NRC to transmit any such certification to Congress and publish it in m

l the Federal Register.

We appreciate the need expressed in your letter for timely guidance to states and compacts.

In that regard Governorspresentingthestaff'weareplanningtoissuealettertoall s position on the issue.

Presently, we envision r

that certifications submitted should include the following information:

I Estimates of the volume of waste and who will generate it after December 31, 1992; L

The proposed storage, dispossi or management actions after December L

31, 1992; The logistics of the proposed action in terms of organizational l

responsibility, timing and scheduling; and Indication that proposed actions are within existing legal l

authorities and are consistent with NRC or Agreement State regulations and/or policies.

Finally as you are aware, the subject of Governor's certifications is on the l

agenda for discussion at the Low Level Waste Forum meeting in Toronto on l
