Dear Senator Bentsen:
I am responding to your letter of May 10, 1990, in which you forwarded a-letter from Mr. Kendall McCook regarding his concerns about the licensing of the Comanche Peak nuclear plant.
The Nuclear Regulatory Commission (NRC) does not have any statutory authority over the rates that electrical customers pay and, thus, it would be inappropriate to comment on those aspects of Mr. McCook's concerns.
We.have addressed other aspects of his concerns in our earlier correspondence to you, the most recent dated April 5, 1990.
The HRC's extensive technical review and inspection of the Comanche Peak plant has been made available to the general public through our Public Document Room facilities, and those efforts have received considerable media attention.
Moreover, the Fifth Circuit of the U. S. Court of Appeals upheld the Commission's decision to deny late intervention and additional public hearings to the Citizens for Fair Utility Regulation (CFUR), an organization that Mr.-McCook represents.
Both the Fifth Circuit Court and the U. S. Supreme Court denied CFUR's petitions to stay the Comanche Peak licensing actions.
I want to assure you that the NRC staff takes its responsibilities for public health and safety very seriously. Mindful of our overriding concern for nuclear power plant safety, we looked into all of the safety concernr raised about the-Comanche Peak plant.
Only after we were satisfied that all of those concerns that cotid affect plant safety had been acceptably resolved, did we recommend-that the Commission authorize the issuance of a full power license for Unit 1.
That license was issued on April 17, 1990. We:will continue to carefully monitor the operation of Comanche Peak Unit 1 to ensure the health and safety of the public.
I hope that this information will be useful in your response to Mr. McCook's concerns.
