This refers to the evaluation of the James A. FitzPatrick Nuclear Power Plant

operated by the New York Power Authority, conducted by- the NRC st:Tf on

November 3, 1990. This report was forwarded to you on January 11, 1990, and

was discussed with you in a meeting at the .VSNRC' Region I Office in King of -

Prussia, Pennsylvania on January 29, 1990.

- The list of attendees at that meeting is attached as Enclosure 1.

that forwarded- the initial SALP Report, and your letter of February 18, 1990,_

- that provided comments relative to that report and the January 29 meeting, are

The- comments provided during the January 29 meeting and in your written

response of February 18 have been considered and some revisions have been made

,

to the SALP Report to correct inaccuracies.

The rationale for these changes

j

is enclosed in the revision sheet, appended as Enclosure 5.

We have reviewed your response relative. to' Radiological Controls and do' not

l

believe that any revision is appropriate.

The resident inspectors were aware

!

of licensee QA findings to which the licensee was not responsive. With respect

i

to the term " lack of sensitivity," its use was not intended to convey a

!

perception 'of apsthetic attitude but, rather, to help you focus on what was

j

,

l

perceived to 'be a lack of awareness.

With respect to department management

l

L

oversight, the' NRC was aware of reviews by supervisors; however, the lack of

department -management review and lack of completion of department directive

documentation that was to have been performed was noted.

Finally, during

i

solidification of radioactive waste, one of three liners exhibited abnormal

response parameters which was not investigated.

experienced some problems with the solidification process, we- consider your

failure to explore the reasons for the abnormal response parameters to reflect

a lack of sensitivity for the need to ensure strict compliance with burial site

requirements. This does~not imply apathy but rather a failure to recognize the

significance of the event.

We believe that the SALP Report, .the meeting dialogue, and your response have

resulted in an objective assessment of the performance of the FitzPatrick

facility.
