inspection on November 27, 1989 Throuah January 23, 1990, and Followup Through March 12, = 1990 (Report No. 90-003l DRS5J )

Areas Inspected: This was a special inspection in response to an' allegation f

(Allegation No. Rill-89-A-0086). that containers with radiation warning labels 1

- had been sent to Wheeler Landfill and they may be contaminating the ground

. water. in that area. The inspection included interviews with personnel from

' Waste Management, State, and Federal agencies. The inspectiornincluded 5

visiting the-house where the containers were seen.

. Resul ts : The allegations were not substantiated and no violations of HRC.-

regulations were found.

Purpose of Inspection

'The inspection was performed in response to an allegation that containersa

.L with radiation warning labels had been sent to Wheeler Landfill and they may be contaminating the ground water in that area.

Specific Allegations and NRC Findings

'Alleaation 1-a In September 1988, Waste Management picked up two containers labeled

'i

" Radioactive" at a private residence near Hebron, Indiana-and disposed of them in the Wheeler Landfill.

Findings In November 1989, a truck'. driver who picked up trash for Waste Management in the Hebron, Indiana area was contacted regarding the containers marked radioactive. He stated he-saw two containers labeled " Radioactive" outside a private residence near Hebron, Indiana on September 7 or 8, 1988. The driver stated that the containers were about'the size of a small propa'ne-tar.k. = He remembered that the containers were white or light colored and m

had a yellow diamond shaped label marked "U.S. Government Control Disposal"-

1 and " Generator" or " Generating." He stated that the containers were heavy.-_ The truck driver recalled contacting his dispatcher for 1

instructions and was told not to' take the containers, so they were lef t at the residence. The inspector showed the driver examples of the typical types of containers that are disposed of by mistake and the diamond shaped labels-put on packages used to ship radioactive material (see attached).

The truck driver stated 'he did not recognize any of the containers or the labels shown in the examples.

He stated that the labels he saw on the containers did not have the " radiation propeller" symbcl.

radioactive at.the customer's home. He stated that the drivers were told not to pick up hazardous waste. The dispatcher stated he did not s

remember what happened to the containers marked.-radioactive.

t The-supervisor at Waste Management's Portage, Indiana facility stated he did not recall the incident with the containers marked radioactive. He also stated that the waste they pick up is taken to the Wheeler Landfill.

The supervisor stated that if the containers marked radioactive had been taken to the-landfill by mistake in September 1988, they would be under 700 to 800 feet of trash. He stated-it would be impossible to find the containers because of the amount of trash covering them. The inspector left a " Hazardous Scrap" poster with the supervisor on January 23, 1990 (seeattached). The poster ~was developed to aid industrial firms in recognizing radioactive materials. The supervisor stated that he would review the information on the poster with his truck drivers.

On three occasions, the inspector visited the. house where the containers marked radioactive were seen, but no one was home.

Between January 29, t

and February 9, 1990, the inspector made numerous calls, but was unable to contact the resident by telephone.

A representative from the telephone company stated that as of February'2, 1990, there was a problem with-the. phone line and calls could not be made to the house until.the line was fixed. A letter reauesting the occupant to contact the NRC about this matter was sent in February 1990. On February 26,.

1990, the: current resident of that house called the NRC stating that he ~

had just moved in the house in November 1989, and he didn't know anything about the containers marked radioactive. He stated the former residents moved to: Florida and he did not know how to contact them. He thought his neighbor who-lives to.the. north may have seen the containers marked.

home. The inspector was unable to call that neighbor because his

-i telephone number is unlisted. On March 12 1990, the inspector contacted the neighbor to the south of the house, but they did not remember seeing any containers marked radioactive.

Conclusion The allegation that Waste Management disposed of a container marked radioactive in the Wheeler Landfill could not be substantiated, since there was no evidence that the containars were transported to the landfill. The final disposition of the containers marked radioactive could-not be determined.

If the containers held radioactive material

-and were buried at the landfill, the amount of trash covering them would shield the radiation. There would be no external radiction hazard from radioactive material buried under 700 to 800 feet of trash.

Findings The Vidette Messenger (a local newspaper) reported.that alpha radiation E

was 'found in water wells in the area near Wheeler Landfill (see attached article dated March 10,1989).- The alleger believed that the alpha.

n radiation-could have~been from the containers marked radioactive that a*

_ ere seen outside the home in Hebron, Indiana in September:1988. As w

required by.the State of Indiana, Waste Management has. been. checking the water in test wells around Wheeler Landfill for radioactive'and-hazardous materials. Wheeler has eight wells that are tested-quarterly to determine if hazardous material is leaking-from the landfill into the well water, d.

Water Well.4:showed alpha' radiation, radium-266 and radium-228.

Radium-266-and radium-228 are isotopes normally found-in well water.(NCRP Report-No.:94, " Exposure-of the Population in the United States and Canada From B

Natural Background Radiation")., Since January 1989, the test results-j b

for,Well 4 have shown that the concentrations of radium-'226 and' radium-228.

- were below the Environmental Protection. Agency's lEPA) limit of'

-5 picocuries per~1 iter.- Between January 1989 and October 1989 the gross alpha radiation from Well 4 has varied from 4.3 to 145 picocuries'per i

liter.. EPA's limit for gross alpha is 15 picocuries per liter.

It is 1

common to find. higher than. normal amounts-of radioactive material'in-well d

water around a-landfill,- because deep burial of waste disturbs the soil l

and~ ground water.

The natural radioactive material in' the soil mixed

into the. ground ~ water will' increase the amount of radioactive material in-the water.

Waste Management-and the Indiana Department of Environmental Management i

. plan to retest the well water around Wheeler Landfill in the spring of

.i 1990. The repeat test should clarify any high alpha results.

'The allegation that the radioactive contamination-found in the water wells around Wheeler Landfill was from the containers-marked-radioactive.
