RE: SHOREHAM NUCLEAR POWER STATION, UNIT 1 The Nuclear Regulatory Commission has granted the enclosed exemption from the requirements of 10 CFR 50.71(e)(4). The exemption was requested for relief from the requirements to file your annual ~ update-of the safety analysis report.

(due December 7,1989) and to include all changes up to 6 months prier to the date of filing.

In lieu of the filing schedule of 10 CFR 50.71(e)(4), your sub--

mittal, which will constitute Revision 3 to the Shoreham Nuclear Power Station Updated Safety Analysis Report (USAR), will contain changes as of June 28, 1989 and is to be filed by June 1, 1990.

(June 28, 1989 is the date the Settlement Agreement between LILCO and New York State became legally effective.)

The exemption is in response to your December 5,1989 request.

Based on the staff's evaluation contained in the Safety Evaluation (copy.

enclosed), the Nuclear Regulatory Commission has granted your schedular exemption pursuant to 10 CFR 50.12. The exemption is being forwarded to the Office of the Federal Register for Publication. This completes our action related to l

the above-referenced TAC number.
