The letter is to inform you of the actions planned with respect to specific l

issues raised in'the Emergency Motion filed by you on, March 14, 1990 with the i

Comission on behalf of-Intervenors New England Coalition on Nuclear Pollution,_

Seacoast Anti-Pollution League. and _the Comonwealth of Massachusetts.; Inter-venors' Motion was based on alleged recent, previously, undisclosed industry-reports.of extensive and serious regulatory noncompliance at'Seabrook..

Accompanying the Motion was the affidavit of Robert Pollard'and the Testimony-of Mr. Pollard and Ralph Nader presented before the Subcommittee.on General

-0versight and Operations, Comittee on Interior and Insular Affairs, U.S.

House of Representatives. The Motion argued that:these materials demonstrate that the NRC had no valid technical basis;for finding that the Seabrook reactor complies with the NRC's regulations and is safe to operate.

L In its Order of March 15, 1990, the Coenission denied the Emergency Motion which sought.an extension of the stay-of full power operation set down;by the Comission in its Memorandum and Order of March 1,1990 authorizing issuance -

of a full power license (CLI-90-03). The Commission ;oncluded that no' extension was needed to fulfill the purpose of the stay provided for.in CLI'-90-03. Moreover, the motion failed to address the stay factors specified-in 10 C.F.R. Section 2.788.

The NRC Staff reviewed the substance of the Emergency Motion. Specifically, both the Regional and Headquarters staffs reviewed the three INP0 reports cited in the Congressional testimony. Based on the-Staff's review, I con-cluded that there was no information in the three INPO reports that would change the Staff's conclusion that there is reasonable assurance that the Seabrook facility can be operated safely.

Accordingly, on March 15, 1990, I j

executed the full power license for Seabrook.

The Motion (Petition) has been referred to my office for the preparation of a response pursuant to 10 C.F.R. Section 2.206. As provided by Section 2.206,
