Dear Sir:

It has come to my attention that the hearing on the facility operating licenses for Palo Verde Nuclear Generating Station, Units 1, 2 and.3, scheduled for March 30, 1982, has been or soon will be postponed unti1~3ometime~ late in April.

Since the Arizona Municipal Water Users Association (MGEJA) has been granted a right of limited-appearance before the Atomic Safety and Licensing Board ~(Board) in respect to these l

proceedings,.we would appreciate immediate notification of any changes in.the schedul6d hearing ~date.

As you are aware, Agreement No. 13904 pursuant to which the member cities of the'AMWUA--Glendale, Mesa, Phoenix, Scottsdale Tempe and Youngtown--will supply effluent to the Arizona Public Service Company, et al., for cooling purposes at the Palo Verde Nuclear Generating Station is being renegotiated.

originally, we had anticipated that the renegotiations would I

be concluded no later than the' middle of March and that the Palo Verde Nuclear Generating Station would thereby have had its water supply assured.

However, and in all candor, I must report that the negotiations are not going well.

In fact, our last meeting (March 11) was totally unproductive and-as the attached letter from Arizona Public Service indicates, future meetings appear unlikely.

Negotiations are at a standstill.

We, however, because of-the serious nature of the problem are hopeful of resolution and, thus, are

exploring other approaches to the renegotiation of Agreement No. 13904.

Furthermore, it would aid us to know if our limited appearance will be oral in nature or whether a written statement will be requested.

We would prefer to make an oral statement at our limited appearance.

In any event, and if the Board thinks it will serve a useful purpose, we would be pleased to furnish the Board, prior to the hearing, background materials on matters referred to in our letter of August 5, 1981.

In addition, we also would be happy to furnish other background materials that will i

set.forth the present municipal position and locate the issue of the use of municipal effluent for nuclear power production within the vider context of water and energy resources management in and between Arizona, California and other states and political entities claiming rights to waters from the Colorado River.
