Dear Mr. Denton:
On February 27,
- 1981, Carolina Power Light Company
("CP&L") filed with the Nuclear Regulatory Commission a "PePition for Hearing Concerning Order for Modification of License and Grant of Extension of Exemption".
The Petition was filed in response to the " Order of the Commission for Modification of License and Grant of Extension of Exemption" entered in each of the captioned dockets on January 13, 1981.
In the Petition, CP&L sought a hearing concerning the portion of each Order which established completion dates for the design and installation of modifications required for compliance with the Acceptance Criteria in Appendix A to NUREG-0661 of February 28, 1982 and November 30, 1981 for Brunswick Unit No. 1 and Brunswick Unit No.
2, respectively.
A hearing in the matter had been deferred pending efforts by the Commission staff and CP&L to resolve the issues involved by administrative means.
I On January 19, 1982, the Commission issued an Order in each of the captioned dockets which modified the January 13, 1981 Orders.
These most recent Orders revise the completion dates for all plant modifications required for compliance with the Acceptance Criteria in Appendix A to t:UREG-0661 in the following respects:

Brunswick Unit No. 1 - completion of the modifications is to occur prior to the start of Cycle 5; 0

Brunswick Unit No. 2 - completion of the modifications is to occur prior to the start of Cycle 6.
These revised completion dates are reasonable ones which adequately take into account CP&L's refueling schedules and other relevant factors and these dates are achievable by CP&L.
CP&L, therefore, is enclosing for filing a Withdrawal of its Petition for Hearing of February 27, 1981.

The issue to be addressed in such hearing has been rendered moot by the issuance by the Commission of a " Modification of January 13, 1981 Order" in each of these dockets.
CP&L, therefore, hereby withdraws its Petition of February 27, 1981.
