Oyster Creek Nuclear Generating Station Docket No. 50-219 Notice of Violation, EA 82-36 The purpose of this letter is to respond to your February 12, 1982 Notice of Violation.

For clarity the violation is repeated in its entirety and followed by our response.

Violation:

10 CFR 50.54(s) and Appendix E to 10 CFR Part 50 (46 FR 63032, December 30, 1981) require each nuclear power reactor licensee, by February 1, 1982, +o demonstrate that administrative and physical means have been established for alerting and providing prompt Instructions to the public within the plume exposure pathway emergency planning zone.

Contrary to the above, by letter dated February 1, 1982 the licensee notified the NRC that it would not be able to demonstrate by February 1, 1982 that administrative and physical means had been estab!!shed for alerting and promptly providing public Instruction within the plume exposure pathway emergency planning zone for the Oyster Creek Nuclear Generating Station, Unit 1.

Response

The violation is correct as stated with the following exception:

- The NRC was first informed + hat we would most !!kely not meet the required February 1, 1982 deadline for having our system installation complete by our October 23, 1981 letter. This letter was then followed by our exemption request dated December 31, 1981 which was further supplemented by a meeting with your staff on January 28, 1982 and by letter dated February 1, 1982.

s The reasons for the violation were described in our December 31, 1981 Exemption Request as supplemen+ed by our January 28, 1982 meeting with your staff and our February 1, 1982 letter to the commission.

In summary, the delay was caused by difficulties in obtaining rights-of-way for the Installation of our sirens. The granting of rights-of-way is beyond the control of GPU Nuclear and this formed the basis for our original exemption request.

The pub!!c information system Installation was completed on March 5, 1982 and Individual siren testing was completed on that same day. This comp!'etion date of March 5, 1982 is substantially ahead of the July 1, 1982 completion date we requested in our exemption request.

On December 31, 1981 when we made our exemption request, we had obtained only 13 of the required 46 rights-of-way; by February 1, 1982 we had received an additional 17 rights-of-way making the total 30 and by February 26, 1982, we had obtained all but one right-of-way.

We consider that this demonstrates our effect!ve and diligent commitment over the past year to comple+e the installation of our prompt no+1fication system at the earliest possible date.

In order to ensure that the pub!Ic is aware of the new siren system and of what to do in the event it is initiated, we have been working with local of ficials in providing information to the public on what to do, during a drill or a real emergency. This program started in January of this year and will culminate with our fu!! scale emergency drill scheduled for March 16, 1982.

The program has consisted of radio programing, news releases and meetings with specific groups that require special attention (i.e. teachers).

When it became evident that we might not make the February 1,1982 deadline we made every ef fort to keep your staf f informed of our problems and the current status of our system. This effort began with our October 27, 1981 comments on the proposed rule to change the original July 1, 1981 Implementation date to February 1, 1982.

Letters dated October 23, 1981, December 31, 1981, February 1, 1982, February 22, 1982 and March 3,1982 described our status and problems.

In addition, we discussed this situation with your staff in a meeting on January 28, 1982 and notified them periodically by telephone of our progress.

The compensatory measures in effect from February 1, 1982 until March 5, 1982 are described in our February 1, 1982 letter to the Commission.

in addition, we feel tha+ on February 26, 1982 there was reasonable assurance that the public could have been notified within the time fraine specified by the regulations. On that date, 45 of the 46 sirens were Installed and tested, the Ocean County Of fice of Engineering Management was aware of the small area without siren coverage, and they could have notified the residents in that area utilizing the methods described in our February 1, 1982 letter.

The current sta+us of the system is that all sirens have been installed and tested and the mas +er control breaker for the siren initiation system is open with Instructions to the Group Shif t Supervisor to have it closed in the event of an emergency.

It is our intention to conduct a full test of the en+1r i system during our full scale exercise on March 16, 1982 and to formally turn over control of the system to the County shortly thereafter.

Based upon the facs that the deIays in meeting the regulation were beyond our control, the good fal+h effort on our part to meet the deadline, and that we
