RBurnett Gentlemen:
This is in response to your letter dated October 22, 1981 requesting an exemption from those regulations in 10 CFR Part 70 dealing with the material control and accounting for more than one (1) effective kilogram of special nuclear material (SNM).
Due to the fact that your actual holding of SilM has decreased to a level below one (1) effective kilogram, we have detennined that granting the requested exemption will not endanger the connon defense and security and that it is othemise in the public interest to do so. Accordingly, effective immediately, we are deleting all of your present license conditions (Sections 1.0 thruugh 8.0) and adding new License Condition 2.1 to Materials Plant Protection Amendment MPP-1 to License flo. SNM-23, Docket 70-33, as reflected in the enclosure to this letter. As a result of this action, you are no longer required to follow the material control and accounting plans which have been in effect at your facility.

Revision of Sections 1.0 Through 8.0 In Their Entirety of Amendment No. MPP-1 to License No. SNM-23 2.0 Facility Operation 2.1 Notwithstanding those sections within 10 CFR 70 which establish material control and accounting requir'ements for licensees authorized to possess special nuclear material in quantities exceeding one (1) effective kilogram, the licensee may follow the material control and accounting sections of 10 CFR 70 as though only authorized to possess less than one (1) effective kilogram of SNM, provided that the licensee does not possess at any one time SNM in a quantity equal to or greater than one (1) effective kilogram.
