l DRAFT DRAFT f1E!!0RANDUM Concerning Conference Call of March 15, 1982 Setting A Date For Hearing.
A telephone conference call was held on March 15, 1982, at 10:30 a.m. Eastern Standard Time to set a new hearing schedule. The new hearing schedule was necessitated by this Board's anticipated rulings on the Applicant's and Staff's motions for summary disposition and Intervenor Lee Hourihan's time to reply to those motions, which reply was to be in the hands of this Board not later than March 15, 1982.
See Memorandum and Order, March 3,1982. Those taking part in the conference call were Rand L. Greenfield on behalf of the State of New Mexico, Charles Bischoff on behalf of the Applicants, Edwin J. Red s on behalf of the NRC Staff and Administrative Judge Robert M. Lazo.
Mr. Reis advised that an attempt was made to have Lee Hourihan take part in the conference call. The NRC Staff had previously contacted all parties, including Lee Hourihan, and arranged for this conference call to take place at 10:30 a.m. Eastern Standard Time on March 15, 1982. The arrangements made with Ms. Hourihan were that she would be contacted at that time at a law office in Boston, Massachusetts ((617) 277-5588) to take part in the conference call. The Staff stated during the conference call that when it called the Boston number for this conference, it was advised it could contact Ms. Hourihan in Phoenix, Arizona at (602) 268-0173.
The Staff called that number and Ms. Hourihan answered the telephone and

.. stated to the NRC Staff that she did not wish to be contacted by the conference operator at that time and that she was not prepared to take part in the conference call at that hour.
Thus Ms. Hourihan elected not to take part in the conference call at the hour arranged.
The other parties and Judge Lazo proceeded with the conference call at the set time. Judge Lazo stated on behalf of the Licensing Board that he would rule on the Applicants' and the NRC Staff's motions for summary disposition, and then set a date for hearing, if a hearing is necessary.
After further discussion between Judge Lazo and the parties to the con-ference call a tentative date of April 27, 1982 was set for the commence-ment of any needed hearing in the proceeding.
