My letter of September 25, 1981, indicated NRC staff concurrence regarding you b

decision to place a surcharge loading on the valve pits adjoining the ring foundations of the Borated Water Storage Tanks for Midland Plant, Units 1 and 2.

By telephone discussions on January 26, 1982, by hearing testimony during the February 16 session, and by meetings on February 23 and 24,1982, the staff has been advised the results of the surcharge program.

The data provided the staff have included curves of settlement with time at various monitoring points marked on the pits.

On the basis of the settlement behavior observed under the influence of the surcharge, the staff agrees that the future diffe.ential settlements between the valve pits and the ring foundation will be small and within the predicted differential settlenent limits, which are enveloped in the structural analysis for the Borated Water Storage Tanks. Accordingly, the staff agrees with your decision to remove the surcharge for the BWST valve pits.

This confirms the verbal concurrence stated during the meeting with your staff on February 23, 1982.
