STIPULATED PROTECTIVE ORDER This Stipulated Protective Order is entered into effective thej2 T day of February, 1982 in accordance with 10 CFR S2.740(c).

The Parties to this Agreement are Citizens For Safe Energy ("CSE"), Quad Cities Alliance For Safe Energy and Survival ("QASES") and Commonwealth Edison Company

(" CECO").

WHEREAS, CECO has applied to the Nuclear Regulatory Commission ("NRC" ) for a license to install new high density spent fuel storage racks at the Quad Cities Nuclear Power Generating Station; and WHEREAS, CECO has retained Joseph Oat Cor-poration to manufacture said new high density spent fuel storage racks; and WHEREAS, CSE and QASES have intervened in the NRC licensing proceeding concerning such storage racks and have informally requested a copy of Joseph Oat's i

Quality Assurance Manual and CECO's quality assurance audit of Joseph Oat Corporation; NOW THEREFORE, the parties agree as follows:

1.

It is agreed between the parties that information provided to CSE and QASES in connection with the licensing proceeding, when indicated in writing by CECO to be proprietory or confidential (hereinafter collectively referred to as " proprietary"), shall be retained by the parties in confidence and shall not be published or otherwise disclosed, other than by express written consent of CECO, providing, however, that nothing herein shall prevent any NRC Administrative Judge from conducting an in camera inspection of such materials.

Joseph Oat Corporation's Quality Assurance Manual and audit reports of investigations of Joseph Oat Corporation conducted by CECO, as well as any correspondence related thereto, is agreed by the parties to be proprietary.

2.

It is further agreed that CSE and QASES will return all proprietary information obtained from CECO, or any of its consultants, following the conclu-sion of this licensing proceeding.

Prior to delivery of any proprietary information to the NRC Staff, or any attempt by CSE or QASES to introduce proprietary information into evidence O

i in this proceeding, CECO, or any of its consultants which might have provided said proprietary information, shall be afforded the opportunity to obtain from the NRC a protective order in accordance with 10 CFR S2.790(b) which protects the proprietary nature of the information to be submitted to the NRC or to be admitted into evidence in the course of this licensing proceeding.
