Appendix NOTICE OF VIOLATION St. Joseph's Hospital License No. 12-01363-01 As a result of the inspection conducted on February 10, 1982, and in accordance with the Interim Enforcement Policy, 45 FR 66754 (October 7, 1980), the following violations were identified:

1.

License Condition No. 14 requires that all licensed material be possessed and used in accordance with statements, representations and procedures contained in applications dated October 7, 1977, and August 4, 1981; letter dated January 10, 1978; request dated January 19, 1979; and ALARA Program as confirmed in application dated August 4, 1981.

The license application dated October 7, 1977, states that a wipe test of the surface of packages containing radioactive materials shall be performed.

Contrary to this requirement, wipe tests of the surface of packages containing radioactive materials were not performed since the date of license issuance.

This is a Severity Level V violation (Supplement VII).

License Condition No. 14 requires that all licensed material be possessed and used in accordance with statements, representations and procedures contained in applications dated October 7, 1977, and August 4, 1981; letter dated January 10, 1978; request dated January 19, 1979; and ALARA Program as confirmed in application dated August 4, 1981.

The license application dated October 7, 1977, states that the pro-cedures described in Appendix C, Part II, of the NRC Draft Licensing Guide dated February 1976, shall be followed for performing routine surveys. Appendix C, Part II states that routine surveys shall include a wipe test of the storage areas.

Contrary to this requirement, a wipe test of the generator storage area was not performed since the date of license issuance.

This is a Severity Level V violation (Supplement VII).

The letter dated January 19, 1979, states that the camera room exhaust fan shall operate continuously.

Contrary to this requirement, the camera room exhaust fan was operated for only 18 minutes during patient studies.

This is a Severity Level V violation (Supplement VII).

License Condition No. 14 requires that all licensed material be possessed.and used in accordance with statements, representations and procedures contained in applications dated October 7, 1977, and August 4, 1981; letter dated January 10, 1978; request dated January 19,^ 1979;- and ALARA Program as confirmed in application dated August 4, 1981.

The letter dated January 19, 1979, describes the procedures for determining the xenon-133 gas trap efficiency.

Contrary to this requirement, you failed to follow the procedures described in your license for determining the xenon-133 gas trap efficiency.

This is a Severity Level V violation (Supplement VII).

Pursuant to the provisions of 10 CFR 2.201, you are required to submit to

this office within thirty days of the date of this Notice a written state-ment or explanation in reply, including for each item of noncompliance:

(1) corrective action taken and the results achieved; (2) corrective action to be taken to avoid further noncompliance; and (3) the date when full com-pliance will be achieved. Under the authority of Section 182 of the Atomic Energy Act of 1954, as amended, this response shall be submitted under oath or affirmation.

Consideration may be given to extending your response time for good cause shown.
