In your February 5,1982 (P-82033) letter to Syd Ball of ORill yotrraised several questions regarding an ORf!L proposed study of public response to the FSV emergency exercise.

I would like to point out several items in regard to proposed studies by flRC contractors and any information obtained as a result of these studies.

Any; proposed study submitted by a laboratory is evaluated in terms of its need to the NRC. Its purpose and result. The study mentioned in S. Ball's monthly report of January 18, 1982 is just that, a proposed study.

It will be evaluated based on the above qualifications. Such a study has been mentioned to the FSV project manager and the response was that NRR is not in a position to require such a study.

If a public response to an emergency exercise is required, it would be of interest to either iluman Factors or Emergency Preparedness Division of the NRC.

As a general comment on NRR acceptance of contractor reports, I must remind you that we, the NRR staff, have the final word on applicability of the contractor reports to a plant or issue under review.

We have tried to facilitate flow of information between PSC and ORNL by not requesting that all correspondance go through the NRC.

In this way we feel that the exchange of information can be facilitated where access to plant information is required. However, you must remember that recom-(

mentlations from our contractbrs represent only one source of information l

used by the NRC in arriving at its conclusions. Any licensing action l

related to these conclusions will be directed to the licensee.

Your letter P-82033 reflects some of the confusion that can occur if i

l the NRC contractor's recommendation are not viewed in this context.

When you have concerns related to our contractors questions or prcposals i

please refer them to me or to the Fort St. Vrain Project Manager.
