PROPOSED MINOR EXPORTS OF DEUTERIUM TO BRAZIL M

Purpose:

To obtain Commission views on the proposed exports.

Review Dates:

60-day period expires on March 19, 1982 for XMA10223.

120-day period expires on May 19, 1982 for XMAT0223.

Review dates are not applicable for XMAT0101 since license remains valid until Commission acts on license extension request.

Discussion:

The proposed exports discussed in this paper involve small quantities of deuterium and, as such, would not normally be referred to the Commission for review. However, in view of possible proliferation concerns regarding Brazil,which have previously been brought to the Commission's attention, the staff believes Commission review is warranted.

Executive Branch review of these two cases is not required because the quantity of material requested falls within the limits of the proposed deuterium general license previously

Commission review (Continued) also would not normally be sought for the heavy water requests as the staff was granted generic authority by the Commissioners on June 4,1980 to license all exports of up to 10.0 kilograms of heavy water without referral to the Commission (See SECY-80-237).

In Secy-80-237, the staff provided a generic analysis showing how minor exports of deuterium would normally meet the export licensing criteria in Section 109 of the Atomic Energy Act, as amended, regardless of the country of destination.

In view of the small quantities of heavy water involved, the proposed exports do not present any proliferation concerns.

Small quantities of deuterium compounds are especially useful in nuclear material resonance (NMR) applications in analytical chemistry.

It is the staff's view that the existing proliferation concerns regarding Brazil do not warrant denial of the two pending deuterium export requests and that the proposed exports would nct be inimical to the comon defense and security of the United States.

Recommendation:

That the Commission authorize the issuance of the proposed license and license amendment to Aldrich Chemical

'and Sigma Chemical.
