SUMARY OF FEBRUARY 16, 1982 MEETING lhTRODUCTION The hRC staff nat with representatives of the Duke Power Company (Duke) on February 16, 1962, in the NRC staff offices in Bethesda, !!aryland. The purpose of the r:ecting was for Duko to obtain initial cor.raents froia the staff on a contemplated conversion of the application for peralits to construct Perkins nuclear Station, Units 1, 2 and 3, to an applicaticn for an early site review.

BACt4ROUW The application by Duke for licenses to construct Perkins Huclear Station, Units 1, 2 and 3, was docketed on May 23, 1974.

The results of the staff's construction permit review were published in a Final Lnvironnental Staterent, NUREG-75/030, October 1975, Safety Evaluation Report, HUREG-Olm, March 1977, and d huppleRent to the safety tvaiuation Report, huRtc-0188, Juiy 1977.

Puolic hearings by the Atoaic Safety and Licensing Board were conducted on April 26-30 and ! ay 6,1976, and on April 26-29 and July 18-21, 1977. On June 15,1978, the staff filed a motion to reopen the evidentiary record for a reanalysis of alternative sites.

Adcitional hearings on alternative sites and generic safety issues were conducted on January 29-31 and February 1-2, 1979.

Three Partial Initial Decisions, LPB-78-25 [ 6 hRC 87 (July 14,1978)],

LPD-78-34 [8 hRC 470 (October 27,1978)], and LPB-80-9 [11 HRC 310 (February 22, 1960)3 were issued. The first pertained to Radon-222, the second to all issues except alternative sites and generic issues, and tne the third to alternative sites. The Intervenors,liary Appersnn Davis and The Yadxin kiver Connittee, appealed the last Partial Ir.itial Decision. The Atoaic Safety asia Licensing Appeal Board heard oral argurent on the alternative sites issue on April 1,1981.

The Appeal Board has not issued the results of its review of the alternative site issue, nor has it scheouled appeals frou other issues resolved in any of the three Partial Initial Decisions.

Following the Three Mile Island Unit 2 (Till-2) accident in liarch 1979, the Intervenors filed a notion with the Licensing Board on April 3,1979, to reopen the record due to lill-2, and a second motion on July 10, 1979, to cisaiss OFFICE)

The Licensing board deferred ruling on the r..otion concerning Thl-2 and on liay 14, 1981, granted a portial stay of the proceeding for two years as suggested by Duke.

On April 6,1981, the staf f initiated a resu.aption of reviews of construction peruit and uanufacturing 11 cense applications that were pending at the time of the Three lille Islano 2 accicent. Duke did not subait infoniation for such a review of the Perkins facility.

On February 3, 1902, Uuxe in a press release announced that Duke Power Conpany's ndnageNent would reCodiend to Duke's board of Directors on February 23, 1982, that the application for pennits to construct the proposed Perkins Muclear Station be withdrawn and that it would atteupt to retain the site for future development.

by letter et February 3,1962, Duke advised the Licensing Board of Duke's manageuent's intent to recorr.end withdrawal of the application for a construction pernit. A copy of that letter with the press release as an enclosure is enclosed.

This necting was requested by Duke personnel to develop guidance regarding the proposed conversion of the construction peruit application to an applicotiori for an early site review. Present were representatives of the staff. Duke, and counsel for tne Intervenors.

NLETIhb SumARY The opplicont is considering filing an application for an early site review pursuant to 32.600 of the Couaission's regulations. That application would request that the construction penait application serve as the basis for the early site review oy the staff and that applicable portions of the staff's Safety Lyaluation Heport and Final Environmental Stateme9t be used as the sources of intoraation for the staff's Early Site Report.

The statf noted that since the hearin9s it had not becone awore of inton:.ation that would have proapted the staff to revise the results of its site suitability now before tne hearing ocard, however, prior tu coupletion of an early site review the staff would likely request that the applicant confinn that it knows of no new infonaation applicable to site suitability.

The staf f indicated that there was no precedent for conversion of a coupleted construction pen,iit review to an application for en early site review, although omcc>

1 the staf f stated that there appearea to be no technical constraints to the conteoplated conversion. The Staff and the applicant egreed that legal counsel should further explore procedural matters.
