REVIEW 0F RADIOLOGICAL CONTINGENCY PLAN

Background===

The BabcocR & Wilcox Lynchburg Research Center (LRC) is authorized by NRC License No. SNM-778 to possess large quantities of hyproduct, source,

and special nuclear materials for its operations in connection with the development of nuclear fuels and the operation of a critical experiment facility and a research reactor. The LRC comprises three main buildings located on an isolated, rural site within a bight of the James River.

The site covers nearly a square mile and is shared with two fuel fabri-cation plants also owned and operated by Babcock & Wilcox.

On August 8, 1981 LRC submitted to the Commission a Radiological Contingency Plan in compliance with an Order issued by the Commission on February 11, 1981.

On December 21, 1981, staff requested additional information and clarification from LRC, which was provided in LRC's Revision 1 submitted on January 26, 1982.

II. Discussion The LRC Radiological Contingency Plan as originally submitted generally addressed all major areas of concern in a satisfactory manner. Minor deficiencies cited in the NMSS letter of December 21, 1981, were adequately addressed in the response of January 26, 1982. The LRC emergency response capability is augmented by the resources of the large Babcock & Wilcox Naval Nuclear Fuel Division facility on the same site.

LRC operations consist of engineering and physics experiments and tests.

No routine manufacturing operations are carried out.

Conclusions and Recommendations The LRC license should be amended to incorporate the Radiological Contingency Plan dated August 8, 1981, and revised on January 26, 1982, as a condition of the license. The proposed amendment should have no adverse effect on the public health and safety or on the quality of the environment and should improve LRC's ability to protect against, respond to, and mitigate the consequences of an accident involving radioactive materials.

The licensee shall implement, maintain, and execute the response measures of his Radiological Contingency Plan submitted to the Commission on August 8, 1981, and revised on January 26, 1982.

The licensee shall also prepare and maintain implementing procedures for his Radiological Contingency Plan as necessary to implement the Plan.

The licensee shall make no change in his Radiological Contingency Plan that would decrease the response effectiveness of the Plan without prior Commission approval as evidenced by a license amendment. The licensee may make changes to his Radiological Contingency Plan without prior Commission approval if.the changes do not decrease the response effectiveness of the Plan. The licensee shall maintain records of changes that are made to the Plan without prior approval for a period of two years from the date of the change and shall furnish the Chief, Uranium Fuel Licensing Branch, Division of Fuel Cycle and Material Safety, NMSS, U. S. Nuclear Regulatory Commission,, Washington, D. C.

20555, and the appropriate NRC Regional Office specified in Appendix D of 10 CFR Part 20, a report containing a description of each change within six months after the change is made.
