i APPENDIX A NOTICE OF VIOLATION Veterans Administration Center License No. 47-00714-02 As a result of the inspection conducted on August 26, 1981, and in accordance with the Interim Enforcement Policy, 45 FR 66754 (October 7,1980), the following violations were identified.

A.

10 CFR 20.305 requires that no licensee shall treat or dispose of licensed material by incineration except as specifically approved by the Commission.

Contrary to the above, on June 24 and July 17, 1981, you disposed of 25.1 microcuries of Sulfur-35 by incineration without approval.by the Commission.

This is a Severity Level III Violation (Supplement IV.C.6).

B.

License Condition 16 requires that licensed material be used in accordance with statements and procedures contained in your application received September 9,1977. One procedure in your application requires-that the work area be monitored for contamination on a daily basis.

Contrary to the above, the work area was only being monitored for contamina-tion on a weekly basis.

This is a Severity Level V Violation (Supplement IV.D.2).

Pursuant to the provisions of 10 CFR 2.201, you are hereby required to submit to this office within thirty days of the date of this Notice, a written statement or explanation in reply, including: (1) admission or denial of the alleged viola-tions; (2) the reasons for the violations if admitted; (3) the corrective steps which have been taken and the results achieved; (4) corrective steps which will be taken to avoid further violations; and (5) the date when full compliance will be achieved. Consideration may be given to extending your response time for good cause shown.

Under the authority of Section 182 of the Atomic Energy Act of 1954, as amended, this response shall be submitted under oath or af firmation.

The responses directed by this Notice are not subject to.ne clearance procedures of the Office of Management and Budget as required by the Paperwork Reduction Act of 1980, PL 96-511.
