SUBJECT:

ENFORCEFiNT ACTION - VETERANS ADMINISTRATION CENTER, LICENSE NO. 47-00714-02 The enclosed letter and Notice of Violation which contains one violation catego-rized as a Severity Level III (Supplement IV.C.6), for which we did not propose a civil penalty was issued after I received telephone concurrence from R. Wessman.

In that no report was prepared, the purpose of this memo is to document the facts surrounding the violation.

The amount of Sulfur-35 incinerated was 25.1 pCi (0.28 MPBB) and presented no significant health problem to employees or the general public. Apparently, this violation resulted from licensee confusion as to what is allowed by the new 10 CFR 20.306. He erroneously believed that the new incineration waiver applied to all medical isotopes, rather than just Hydrogen-3 and Carbon-14. The Sulfur-35 was contained in rodent carcasses that were no longer needed for research. Based on the above, we did not feel a civil monetary penalty was warranted.
