Gentlemen:
lie have received a copy of your application dated July 21, 1931, which was filed with the Office of Nuclear Reactor Regulation (0'iRR) for review. This application requested extension of construction coupletion dates for liashington Public Power Supply System Huclear Projects Units 1 and 4.
A Class II fee ($1,200) and a Class I fee ($400) were submitted with your application, pursuant to 10 CFR 170.22.
By letter dated Deceuber 31, 1931, your coapany withdrew the extension request for Unit 4.
l Under the provision of 10 CFR 170.12(a), the USNRC may retain fees for withdrawn applications. However, the 0;1RR review staff has informed us that no review of your July 21, 1981 application had coar,enced when the request for Unit 4 was withdrawn. On this basis, we have concluded that an exemption pursuant to 10 CFR 170.ll(b) from the fee requirements is hereby authorized by law and such exenption is otherwise in the public interest and is hereby granted for the Unit 4 portion of this application.
Accordingly, we are concurrently authorizing the Office of the Controller to refund $400 to you. Refunds are generally processed within a two week period.
