Gentlemen:
Consistent with Consumers Power Company's ("Liccn-see") policy of full disclosure, I am enclosing copies of two letters, to wit:
1.
Letter dated Jhnuary 20, 1982, from Mr. Russell B. DeWitt, Vice President, Nuclear Operations, Consumers Power Company, to Capt. Hickey of the Ohio Air National Guard.
2.
Letter dated January 29, 1982, from Mr. Frederick W. Buckman, Executive Director of Nuclear Acti-vities, Consumers Power Company, to Mr. Ed Heaps of the Federal Aviation Administration.
These letters are relevant to the pending motion filed by Inter-venors Christa-Maria, et al., to expand the contention of Mr.

Mr. DeWitt's letter indicates that the Licensee finds acceptable the commitment to the "no-fly" area defined by Capt.
Hickey of the Ohio Air National Guard.
Mr. Buckman's letter requests the FAA to memorialize the "no-fly" area on applicable flight-planning charts, thereby extending that limitation to all aircraft.
Licensee is continuing discussions with Capt. Hickey to assure that the "no-fly" limitation is effectively imple-mented by the Ohio Air National Guard.

It is our conclusion that the action you have taken to redefine the =111tary airspace boundaries Your concern provides the necessary positive steps to prevent recurrence.

The present airspace definitions for the Helverine Military Operating Area (MOA) inscribe a 5 nuatical mile "No Fly" zone below 5000ft around the town of Char.levoix,.Nichigan.
This "No Fly" ama provided the Big Rock Point nuelear Power Statten with a 1 nautical mile buffer from military activites.

It has been brought to our attention that military fighter type aircraft have been observed 1 nautical mile from the plan: but renoced as everflying it by. plant personnel.
This occurrence has raised concern by cath Nuclear Regulatory Ccemission and military officials and has precipitated redefinition l
of the ciittary airspace boundaries.
3.
Effective inTnediately, an additional "No Fly" area wf11 be established speciffcally around the Big Rock Point Nueclear Fewer station.
This area will ha 2 nautical miles in radius with a ceiling of 1500ft above ground level.
As enentioned, this will be in addition to the "No Fly" area around Ch. arlevoix, MI.
4 This new arsa will be briefed to each aircrew prior to flying in the Wolverine MOA.
Aircrews from other units will be briefed oy this unit in acccedance with established military procedures.
5.

Dear Mr. Heaps:
Consumers Power Company is the owner and operator of a nuclear electric generating plant known as Big Rock Point Nuclear Plant located near Charlevoix, Michigan. ' Operation of this plant commenced in January, 1963.
The plant's 75,000 kW of generating capacity is an important source of electric power to the northwest portion of lower Michigan.
It is Consumers Power Company's responsibility to the public to ensure the safe operation of the Big Rock Point Nuclear Plant.
A recent aircraft flyover of the plant by the Ohio Air National Guard necessitates positive steps to prevent recurrence ia order to reduce the probability of a crash to the maximum possible extent.
Interaction among Consumers Power Company, the Nuclear Regulation Commission and the Ohio Air National Guard has provided a redefinition of the military airspace boundaries.
The enclosed letter from William P. Rickey to Mr. Kac Campe, dated December 29, 1981, documents Captain Hickey's corrective action of establishing a "no fly" area around Big Rock Point Plant of "two nautical miles in radius with a ceiling of 1500 feet above ground level."
It is requested that the "no fly" area be

indicated by an appropriate special use airspace designation such as " prohibited" or " restricted" area on applicable VFR and IFR planning charts.
j Our cursory review of enroute low altitute and high altitude FAA charts has identified several air routes within a twenty-mile vicinity of Big Rock Point.
These routes, both military and commercial, include the following designations:
l IR600-601, CR1634, V193-233W, and J548 1
2 It is our conclusion that FAA chart designation of the "no fly" area would pro-vide useful information to not only the commercial and military aircraft using the identified air routes, but would also provide an aid to private aircraft planning flights in close proximity to the plant.
Your assistance in initiating appropriate action to accomplish this request is greatly appreciated.
