i BEFORE THE UNITED STATES NUCLEAR REGULATORY COMMISSION In the Matter of Docket No. 50-171 PHILADELPHIA ELECTRIC COMPANY APPLICATION FOR ANENDMENT OF EACILITY OPERATING LICENSE DPR-12 Philadelphia Electric Company is Licensee under Provisional Operating License DPR-12 for Peach Bottom Atomic Power Station Unit 1, a decommissioned high temperature gas-cooled nuclear power reactor located in York County, Pennsylvania.

Licensee is authorized by DPR-12, inter alia, 1/

to possess, but not operate, the Peach Bottom Unit 1 facility.

1/Although paragraph 2.D of Amendment No. 6 to DPR-12 specifies an expiration date of December 24, 1975, Licensee m Je timely application for renewal of the License.

Thus, in accordance with 52.109 of the Commission's Regulations, the license remains in effect until the renewal application has been acted upon.

r Licensee has completed the decommissioning of the Unit 1 facility as described in its Application of August 29, 1974, as I

amended May 15, 1975 and all special nuclear material, including the reactor fuel has been removed from the facility.

A Final Report on the decommissioning of the facility was filed with the Commission in November,1978, and Licensee is maintaining the facility in accordance with the provisions of DPR-12, as amended, and the Technical Specifications of Appendix A thereto.

Licensee plans to utilize certain areas of the Unit 1 facility outside the exclusion area established for the facility as emergency response facilities for the adjacent Peach Bottom Units 2 and 3 which Licensee operates pursuant to Facility Operating Licenses DPR-44 and DPR-56, respectively.

Specifically, Licensee plans to utilize portions of the unrestricted access areas of the Auxiliary, Administration and Turbine Buildings for the Technical Support Center and Emergency Operations Facility i

required by Appendix E to Part 50 of the Commission's Regulations.

To provide a facility for performing post-accident analyses as required by NUREG-0737, "Clarificatian of TMI Action Plan Requirements", Licensee plans to reactivate and equip the original Unit 1 radiochemistry laboratory.

Although these _..

e laboratory facilities are primarily intended for post-accident analyses, Licensee intends to use the facilities for routine analysis of material from Peach Bottom Units 2 and 3 to assure the operability of the facilities and that personnel will be familiar with the facilities in the event of their need for post-accident analyses.

The reactivated radiochemistry laboratory will be located at the first floor of the Unit 1 Administration Building, a three-story structure located approximately 700 feet from Peach Bottom Units 2 and 3.

Reactor coolant and containment atmospheric samples will be transported to the laboratory for radiological and chemical analysis.

The laboratory will be protected by shield walls and a ventilation system utilizing HEPA and charcoal filters to ensure the accuracy of the analysis and to limit personnel dose during a postulated accident.

Access to the Unit 1 Administration Building is restricted by the Peach Bottom security organization.

The laboratory will be equipped with various analytical instru-i ments, including a computer based gamma spectrometry system, gas chromatograph, proportional counter, and ph meter, as well as general laboratory support equipment..

Under License DPR-12, as amended, Licensee is only authorized to possess such byproduct material as may have been produced by the operation of Unit 1.

To permit the use of the Unit I laboratory facilities for analysis of material produced at Units 2 and 3, it is hereby requested that Provisional Operating License DPR-12 be amended to also permit Licensee to possess, but not separate, such byproduct material as may be produced by operation of Peach Bottom Units 2 and 3.

Pursuant to 10 CFR 170.22, " Schedule of Fees for Facility License Amendments", Licensee proposes that this Application for Amendment be considered a Class III Amendment, since the proposed change is deemed not to involve a significant hazards consideration.

The Plant Operation Review Committee and the Operation and Safety Review Committee have reviewed the proposed Amendment, and have concluded that it does not involve an unreviewed safety question or a significant hazards consideration; and will not endanger the health and safety of the public.
