ORDER AUTHORIZING DISMANTLING 0F FACILITY AND DISPOSITION OF COMPONENT PARTS By application dated July 23, 1981, as revised by letters dated September 23, October 16 and November 23, 1981, Babcock and Wilcox Company (the licensee) l i

requested authorization to dismantle the Lynchburg Pool Reactor (the facility),

h a pool-type nuclear reactor located in Lynchburg, Virginia, and to dispose of the component parts,.in accordance with the plan submitted as part 'of. the app 11-cation. A " Notice of Proposed Issuance of Orders Authorizing Dismantling of

. Facility" Disposition of Component Parts, and Termination of Facility License" was published in the Federal Register on October 30,1981 (46 FR 53821). No request.for a hearing or petition for ~1 eave to intervene was filed following notice of the proposed action.

The Nuclear Regulatory Commission (NRC) has reviewed the application in accordance with the provisions of the NRC's Rules and Regulations and has found that the dismantling and disposal of component parts under the licensee's dismantling plan will be in accordance with the regulations in 10 CFR Chapter I, and will not be inimical to the common Uefense and security or to the health and safety of the public. The basis for the findings is set forth in the con-currently issued Safety Evaluation by the Office of Nuclear Reactor Regulation.

The NRC staff has prepared an environmental impact appraisal for this action. Based on that appraisal, the staff has detemined that this action wil;1-not result in any significant environmental impact and that an environ-mental impact statement need not be prepared.

According1'y, Babcock and Wilcox Company is hereby authorized to dis-mantle the facility covered by Facility Operating License No. R-47, and' dispose of the component parts in accordance with their dismantling plan and the NRC's Rules and Regulations.

Af ter completion of the dismantling and decontamination and the submission of a report on the radiation survey to confirm that radiation levels in the facility area meet the values defined in the dismantling plan and an inspection by representatives of NRC, consideration will be given to whether a further order should be issued teminating Facility Operating License No. R-47. ' Alter-natively, after dismantling the facility the licensee may apply to the NRC for inclusion of the residual activity in Special Nuclear Mat [ rials License No. SNM-778. Following an inspection by representatives of the NRC and author-ization to include this residual activity under SNM-778, consideration wili be given to whether e further order should be issued tenninating Faciity
