. Inspection Summary:

Inspection on June 15, 1981 by a Representative of the Nevada Department of Human Resources United Nuclear Corporation was the originator of a waste shipment which was inspected at the U.S. Ecology, Inc.- burial site.

Results: One apparent item of noncompliance was-identified (contents of package were'not so limited as to assure effectiveness of the package).

On June 9, 1981, United Nuclear Corporation dispatched a shipment of licensed material consisting-of 24.42 millicuries of uranium as LSA radioactive waste to the U. S. Ecology, Inc. burial site at Beatty, Nevada. The_ shipment

-was made in seventeen 55 gallon drums and seven wooden boxes in an exclusive use vehicle.

On June 15, 1981, a representative of the Nevada Department.of Human Resources inspected the shipment. The inspection consisted of a review of shipping papers, placarding, marking and labeling requirements, radiation measurements, selective contamination surveys and examination of the packages and tractor-trailer.

A copy of the report prepared by the representative, which includes copies of'related shipping documents, is attached. The report states that, as shipment number 120 was being unloaded at the Nevada burial site on June 15, 1981, package number 1764 was observed to have a 1-1/4" x 2-1/2" hole in its side.

According to a " Radioactive Waste Shipment and Disposal Form" dated June 9, 1981, included among the shipping documents, package number 1764 contained 56.4 microcuries of uranium-235.

Uranium-235 has a specific activity of 2.14 microcuries per gram. A " Shipping Order," included among the shipping documents, identified the contents as " Radioactive materiel LSA NOS."

In a letter to the State of Nevada dated June 16, 1981, the licensee stated that package number 1764 contained material associated with the decommission-ing of a United Nuclear facility, typically pipes, light fixtures, wiring, and concrete blocks, and that prior to shipping, these items had been decontaminated to the lowest level practical. Thus, the contents consisted of objects of nonradioactive material externally contaminated with radio-active material and the licensee's designation of the contents as low-specific activity was appropriate. The letter further noted that, "Apparently, this' hole was created by repeated contact with a piece of pipe inside the box during the 3,000 mile trip from our site to Beatty."

On or about August 10,1981 during a telephone contact, the licensee's Manager of Nuclear and Industrial Safety reported that the contents of package number 1764 were not wrapped.

The observed condition indicates noncompliance with 10 CFR 71.5 which prohibits delivery of licensed material to a carrier for transport unless the licensee complies with the Department of Transportation regulations in 49 CFR 170-189.

49 CFR 173.24(a) required that each package used in such transfer has it: contents so limited that under conditions normally incident to transportation the effectiveness of the packaging will not be substantially reduced.

The United Nuclear Corporation Plant Manager'was informed of this apparent item of noncompliance with NRC requirements in a telephone conversation with P. Clemons of the Region I office on November 6, 1981.
