Subject:

Inspection 70-820/81-08 This refers to an inspection conducted by a representative of the Nevada Department of Human Resources on June 15, 1981 of a shipment of radioactive waste from the Wood River Junction, R.I. facility. The shipment was inspected upon its arrival at the U.S. Ecology, Inc. burial site at Beatty, Nevada.

Areas examined during this inspection are' described in a report by a representative of the Nevada Department of Human Resources which is attached to the Office of Inspection and Enforcement Inspection Report enclosed with this letter. The inspection consisted of a review of shipping papers, placarding, marking and labeling, radiation measurements, selective contamination surveys and examination of the packages and the tractor-trailer.

Based on the results of this inspection, it appears that one of your activities was not conducted in full compliance with NRC requirements as set forth in the Notice of Violation enclosed herewith as Appendix A.

The violation in Appendix A has been categorized at the severity level described in accordance with the Interim Enforcement Policy as published in the Federal Register 45 FR 66754 (October 7, 1980).

You are required to respond to this letter, and in preparing your response you should follow the instructions specified in Appendix A.

The violation for which you have been cited has already been the subject of other enforcement action. On June 23, 1981, the State of Nevada assessed an administrative penalty of $1500.00 against you, and your permit Q407 was suspended for a period of six months. You were also required to provide additional training to packaging personnel and to revise your quality assurance program and procedures and submit them for State review and approval.

In view of the circumstances surrounding this matter, we have exercised our discretion under the Interim Enforcement Policy 45 FR 66754 (October 7, 1980),

and have chosen to issue at this time the enclosed Notice of Violation. After reviewing your response to this Notice of Violation and your proposed corrective actions, the NRC will determine whether further NRC enforcement action is nep ssary in ord o ensure mpliance with NRC regulatory requ rements.

11 JAN 1982 In accordance with 10 CFR 2.790 of the Commission's regulations, a copy of this letter and the enclosed inspection report will be placed in the NRC's Public Document Room.

If this report contains any information that you (or your contractors) believe to be exempt from disclosure under 10 CFR 9.5(a)('+), it is necessary that you:

(a) notify this office by telephone within seven (7) days from the date of this letter of your intention to file a request for withholding; and (b) submit within 25 days from the date of this letter a written application to this office to withhold such information. Section 2.790(b)(1) requires that any such application must be accompanied by an affidavit executed by the owner of the information which identifies the document or part sought to be withheld, and which contains a full statement of the reasons on the basis which it is claimed that the information should be withheld from public disclosure.

This section further requires the statement to address with specificity the considerations listed in 10 CFR 2.790(b)(4). The information sought to be withheld shall be incorporated as far as possible into a separate part of the affidavit.

If we do not hear from you in this regard within the specified periods noted above, the report will be placed in the Public Document Room.

The responses directed by this letter and the accompanying Notice are not subject to the clearance procedures of the Office of. Management and Budget as required by the Paperwork Reduction Act of 1980, PL 96-511.
