Enclosed please find a copy of the emergency planning contention (Contention 22) in the Comanche Peak proceeding as admitted by the Atomic Safety and Licensing Board (" Licensing Board") in its " Order Subsequent To The Prehearing Conference of April 30, 1980," dated June 16, 1980.
Also enclosed for your information is a copy of the letter from Marjorie Rothschild, Esq., to Daniel Cosgrove, Esq., dated July 17, 1981, in which Contention 22 was forwarded by the NRC Staff to the Federal Emergency Management Agency (FEMA).
The NRC Staff is evaluating Revision 2 to the Applicants' on-site emergency plan, which was submitted to the NRC Staff on October 9, 1981.
The NRC Staff understands that the State and local emergency plans for Comanche Peak will be completed in draft form within about one month and will be submitted, in draft, at that time to the Regional Assistance Comittee (RAC). The State and local energency plans are to be formally submitted to FEttA in June 1982, with the joint exercise scheduled for July 1982.
As I recently informed Marshall Sanders of your office, a schedule for litigation of Contention 22 has not yet been established by the Licensing Board.
It is our estimate that the Licensing Board may schedule Contention 22 to be litigated sometime during the Summer of 1982. We believe that it would be advisable for fella to comence its review of Contention 22 with a view toward preparing its testimony.
