C. 20555 h RE: In the Matter of Consumers Power Company (B j, y, Rock Point Nuclear Power Plant), Docket No. rs 50-155-OLA (Spent Fuel Pool Modification) Gentlemen: Consistent with the Consumers Power Company's (" Licensee") policy of full disclosure, I am enclosing a copy of a memorandum, dated December 29, 1981, from Captain William P. Hickey, Jr., of the Ohio Air National Guard to Mr. Kaz l Campe of the U. S. Nuclear Regulatory Commission. This memo-randum is relevant to the pending motion filed by Intervenors' Christa-Maria, et al., to expand the existing contention of John O'Neill (Contention II-D) concerning the effects of a crash of a U. S. Air Force B-52 bomber on the Big Rock Point l Plant. It appears from Captain Hickey's memorandum that action has been taken by the Ohio Air National Guard to increase the "No Fly" area around the Big Rock Point Plant. It is counsel's understanding that the no-flyover limitation 9503 S1 di PW8&To!!ggg, PDR

Shon January 18, 1982 Page 2 means that the Ohio Air National Guard will not overfly a two-nautical-mile area around the Plant at less than 1,500 feet above ground. The Licensee-is continuing its efforts to estab-lish means whereby reoccurrence of the overflights noted in Mr. Marusich's July 23, 1981, memorandum to Mr. F. W. Buckman is avoided. l Sincerely, a ds ,L.,7 Joseph Gallo Enclosure t JG/pm cc: Service List l l l .}}
