Dear Chairman Palladino:

I have just received as part of a press release issued by the Office of Governor Brown on January 18, 1982, a copy of a telegram to the Commission. In it Governor Brown requeated the Commission to "promptly order a halt to the Diablo Canyon verification program now being performed . . . ,

Surely no one can challenge PGandE's right to continue with the independent audit it commissioned early last October.

The issue before the Commission is not whether the program should be halted, it is whether the Commission will accept the consultants and the program in satisfaction of its order of November 19, 1981, for an independent audit. We believe that it should. Much of the Phase I review has been done and no justification has been shown for redoing four months of expert review and analysis.

The capability and qualification of the experts now conducting a design audit have never been challenged. The expert over-seeing all the work being done was on a list suggested by the Governor himself. Any adverse public perception of the audit procedure, if it exists, has been created by the Governor and others who have sworn total opposition to the licensing of the plant under any circumstances.

We can agree with the Governor tnat there has been enough delay, but the delay has been caused in good part by his continued effort to discredit the NRC, its staff, consultants hired by PGandE, and the campany itself. January 19, 1982 Page Two he has chosen to turn the regulatory process into a political and media circus and, by rhet oric, to impugn the motives and integrity of anyone associated with PGandE.

The bald political and propaganda attacks generated by Governor Brown's office should not be permitted to obscure the f acts or influence the deliberations of the Commission acting, as it does, under a charter of independence.
