l APPENDIX A NOTICE OF VIOLATION Northeast Nuclear Energy Company Docket No. 50-423 Millstone Nuclear Power Station, Unit 3 License No. CPPR-113 As a result of the inspection conducted October 30 - November 30, 1981, and in accordance with the Interim Enforcement Policy, 45 FR 66754 (October 7, 1980),

1 the following violations were identified:

A.

10 CFR 50, Appendix B, Criterion XIII states, in part, that:

" Measures 1

shall be established to control the handling, storage, shipping, cleaning and preservation of material and equipment in accordance with work and inspection instructions to prevent damage or deterioration."

The Northeast Utilities QA Program Topical Report, Section 13.2.1 states, in part, that:

" Procedures, instructions and procurement documents define the requirements and responsibilities for the handling, storage, shipment, cleaning and preservation of Category I material, equipment and parts.

The Stone & Webster Construction Methods Procedure 1.12-3.79, Section 2.2.4 states, in part, that:

" Electrical heating elements shall be monitored and/or instrumentation racks energized in accordance with manufacturer's instructions."

Contrary to the above, on November 25, 1981, the internal heaters for 4160 volt switchgear panels NJS-US-6A, -6B, -7A and -7B were not connected to an electrical power source.

This condition had existed since the panels were placed in storage on May 4, 1981. Also, maintenance inspection records incorrectly indicated that on July 10, 1981 and October 9, 1981, the heaters for these switchgear panels were energized and functioning.

This is a severity Level V violation (Supplement II).

10 CFR 50, Appendix B, Criterion XVI states, in part, that:

" Measures 1

shall be established to assure that conditions adverse to quality, such as failures, malfunctions, ceficiencies, deviations, defective material and equipment and nonconformances are promptly identified and corrected...".

The Northeast Utilities (NU) QA Program Topical Report Section 16.1 states, in part, that:

"NU Quality Assurance Program provides documented measures for corrective action to ensure that nonconfortring Category I Systems, structures and components are identified and promptly corrected Contrary to the above, as of November 25, 1981, prompt action had not been taken to correct various deficiencies associated with items in storage identified by the following S&W unsatisfactory inspection reports:

Pursuant to the provisions of 10 CFR 2.201, Northeast Nuclear Energy Company is hereby required to submit to this office within thirty days of the date of this Notice, a written statement or explanation in reply, including:

(1) the corrective steps which have been taken and the results achieved; (2) corrective steps which will be taken to avoid further violations; and (3) the date when full compliance will be achieved.

Under the authority of Section 182 of the Atomic Energy Act of 1954, as amended, this response shall be submitted under oath or af firmation. Where good cause is shown, consideration will be given to extending your response time.

The responses directed by this Notice are not subject to the clearance procedures of the Office of Management and Budget as required by the J

Paperwork Reduction Act of 1980, PL 96-511.
