This refers to an inspection conducted by a representa'tive'ofdh6 South

Carolina Department of Health and Environmental Control on September 18,

J

1981 of a shipment of radioactive waste from the Maine Yankee Nuclear

!

Station. The shipment was inspected upon its arrival at the Chem-

i

Nuclear Systems, Inc. burial site at Barnwell, South Carolina.

Areas examined during this inspection are described in a report by.a

i

representative of the South Carolina Department of Health and Environmental

Control which is attached to the Office of Inspection and Enforcement

!

Inspection Report enclosed with this letter.

The~ inspection consisted

'

j

of a review of shipping papers, placarding, marking and labeling, radiation

!

measurements, selective contamination surveys, and examination of the

j

packages and the tractor-trailer.

i

]

Based on the results of this inspection, it appears that one of your

activities was not conducted in full compliance with NRC requirements as

set forth in the Notice of Violation enclosed herewith as Appendix A.

The violation in Appendix A has been categorized at the severity level

described in accordance with the Interim Enforcement Policy as published

in the Federal Register 45 FR 66754 (October 7, 1980).

You are required

to respond to this letter, and in preparing your response you should

follow the instructions specified in Appendix A.

The violation for which you have been cited has already been the subject

i

of enforcement action by the State of South Carolina. On September 24,

j

1981, the State of South Carolina assessed a civil penalty of $1,000.00

against you. You were also required to submit evidence that adequate

i

measures had been implemented to assure compliance with all applicable

1

provisions of State and Federal law.

!

In view of the circumstances surrounding this matter, we have exercised

our discretion under the Interim Enforcement Policy, 45 FR 66754

j

(October 7,1980), and have chosen to issue at this time the enclosed

l

Notice of Violation. After reviewing your response to this Notice of

Violation and your proposed corrective actions, the NRC will determine

j

whether further NRC enforcement action is necessey in order to ensure

compliance with NRC regulatory requirements.

In accordance with 10 CFR 2.790(a), a copy of this letter and the enclosure (s)

will be placed in the NRC Public Document Room unless you notify this

office, by telephone, within ten days of the date of this letter and

submit written application to withhold information contained therein

within thirty days of the date of this letter.

Such application must be

consistent with the requiremerits of 2.790(b)(1).

The responses directed by this letter and the accompanying Notice

are not subject to the clearance procedures of the Office of

Management and Budget as required by the Paperwork Reduction Act of

1980, PL 96-511.
