ORDER DIRECTING THAT ALL PARTIES BE SERVED WITH FILIllGS IN THIS PROCEEDING On January 18, 1982, Judge Brenner received the attached letter dated January 13, 1982, f rom Dr. Invin D. J. Bross who is a petitioner in this proceeding.

It does not appear that Dr. Bross has served the other parties to the proceeding or the other members of the Board.

In order to avoid delay in this instance, the Board is providing copies of Dr. Bross' letter as an attachment to this order.

Dr. Bross is correct in his observation in the attached letter that correspondence is not automatic?lly retransmitted to the service list. The Board.and presumably the other parties, eventually received copies of i

,. Office of the Secretary of the Commission, on January 11, 1982. Due to this delay, the Board was not aware of the letter at the time we issued our Order of December 31, 1981.

Obviously, a legal proceeding cannot function in the circumstances of the Board and parties receiving correspondance so belatedly, if at all.

The above underscores the strict need in the future for Dr. Bross, and all parties, to comply with the Commission's regulations by serving correspondence to all addressees on the service list, and to so certify by including a certificate of service.

The certificates of service accompanying the NRC Staff's Answers of flovember 27, 1981, accurately list the a::dressees to be served, with the necessary addition of:
