EMcAlpine, Reg. II This is in response to revised attachment 4 to your letter dated August 20, 1981 which requested an exemption from 10 CFR 70.58(e) which would allow you to receive and tranship the low level waste described therein without measuring it.
We have determined that granting you this exemption will not endanger the common defense and security and that it is otherwise in the public interest to do so. Therefore, effective immediately, we are adding the following license condition to your License flo. SilM-1107:
flotwithstanding 10 CFR 70.58(e) which requires measurement of all receipts and shipments of special nuclear material, the licensee may receive and tranship to burial the drums of low level waste described in revised attachment 4 to the letter dated August 20, 1981 without perfoming measurements, provided that the integrity of the tamper-indicating seals affixed thereto is verified prior to shipment.
l We have established that revised attachment 4 to your letter dated August 20, 1981 contains information of a type specified in 10 CFR 2.790(d).
Accordingly, pursuant to Section 2.790(d)(1), such information is deemed to be commercial or financial information within the meaning of 10 CFR 9.5(a)(4) and shall be subject to disclosure only in accordance with the1Q r provisions of 10 CFR 9.12.
