The Nuclear Regulatory Comission (the Connission) has found that:

A.

The application for amendment to Construction Pemit No. CPPR-118, trans-mitted by Mississippi Power and Light Company's letter dated September 26, 1980 and supplemented by letters dated Decenber 31, 1980 and August 31, 1981, complies with the standards and requirements of the Atomic Energy Act of 1954 as amended (the Act), and the Comnissions rules and regulations set forth in 10 CFR Chapter I; D.

The issuance of this amendment will not be inimical to the common defense and security or to the health and safety of the public; C.

There is reasonable assurance (i) that the activities authorized by this amendnent can be conducted without endangering the health and safety of the public and.(11) that such activities will be conducted in accordance with the Commission's regulations; D.

The issu.ince of this anendment is in accordance with 10 CFR Part 51 of the Coonission's regulations and all applicable requirements have been satisfied.

Accordingly, the Huclear Regulatory Connission has issued Amendment flo. 7 to Construction Pemit No. CPPR-118. The amendnent changes condition 3.E(1) of CpPR-118 by deleting the monitoring and capacity requirements for sedinent retention basins from the Environnental Protection Program Respecting Construction of Grand Gulf !!uclear Station, Units 1 and 2.

Amendnent to Construction Permits - Grand Gulf Nuclear Station, Units 1 and 2 By letter dated Septenber 26, 1980 and supplemented by letters dated December 13, 1980 and August 31, 1981, you requested amendments to Construc-tion Pemit Nos. CPPR-il8 and CPPR-119 for the Grand Gulf Nuclear Station, Units 1 and 2.

You proposed deleting from the pemits a requirement in Condition 3.E(1). This requiresient, which appears in the Environmental Protection. Program Respecting Construction of the Grand Gulf Nuclear Station, Units 1 and 2, involves the monitoring and capacity of non-safety related sediment retention hasins at the Station. The staf f, after review, has deter-mined that the NPDES pemit (Pemit No. MS0029521), issued by the liississippi Departnent of Natural Resources, Bureau of Pollution Control (DNR), wnich contains restrictions on the capacity and dictates nonitoring requirements, is adequate for maintenance ano monitoring of the sediment basins at Grand Gulf. Since a valid HPDES covers the requirement which is proposed for deletion from_ the construction pemits, we have concluded that the' sediment basins' monitoring and capacity requirement, which appears in Condition 3.E (1) of the construction pemits, may be deleted. Amendments No. 7 to CPPR-118 and CPPR-119 are enclosed for that purpose.

"e Sava deter-ined that this is an action which does not authoriza a change in the types or amounts of effluents or any change in power level (10 CFR 51.5(b)(2)) and that this action will not result. in any environnental impact different from that evaluated at the construction pemit stage and authorized by the NRC construction peraiits and the NPDES pemit. Having rade these deteminations, we have concluded that these construction pemit amend.ments involve an action which is insignificant from the standpoint of environmental icoact. Accordingly, pursuant to 10 CFR 51.5(d)(4), an environnental impact statement or a negative declaration and environmental impact appraisal need not be prepared in connection with these amendments.

These amendnents do not involve significant new safety infomation of a type not considered by a previous Conmission review of the facility. They do not involve a significant increase in the probability or consequences of an accident. do not invnive a siqnificant decraate in <afp*v maraint and orricz >

A1 so, based on the above description of this action and our evaluation of it, we have detcrmined that (1) there is reasonaSle assurance that the public health' and safety will not be endangered by these construction permit amendments, (2) the activities authorized by the amendments are in compliance with the Commission's regulations, and (3)' the issuance of the amendments will not be inimical to the common defense and security or to the health and safety of the public. This change recognizes reliance on the NPDES permits for specifying conditions for the protection of the aquatic environment.
