In response to the Board's Order. scheduling Prehearing Conference

dated November 5, 1981, Petitioner Palmetto Alliance proposes '

contentions 30, 33, 34, 39 and 48 filed December 9, 1981', in the Palmetto Alliance Supplement to Petition to Intervene as well as i

Carolina. Environmental Study Group contentions-1, 5, 6, 12 and 22 be placed at the top of the agenda under consideration.

It is the position of this Petitioner that litigation-of these issues could preclude the necessity of litigating the remaining 43 contentions. Discovery and trial preparation should begin:immediately on these issues exclusive of the remaining 43 contentions.

Should the Board find contentions 30, 33, 34, 39 and 48 without merit, Palmetto Alliance would reserve the right to further litigate the remaining contentions.

For the January 6 Prehearing Conference, Palmetto Alliance suggests primary consideration be given to Palmetto Alliance contentions 30, 33, 34, 39 and 48, as well as CESG contentions 1, 5, C, 12 and 22. The Petitioner then suggests the remaining contentions be taken sequentially.

Palmetto Alliance also reserves the right to comment on responses to Petitioner's Supplement to Intervention.
