US Nuclear Regulatory Commission Washington, DC 20555 DOCKET 50-155 - LICENSE DPR BIG ROCK POINT PLANT - PROMPT PUBLIC NOTIFICATION SYSTEM By letter dated November 6, 1981, Consumers Power Company (CP Co) committed to the installation of an immediate warning system at Big Rock Point Plant by February 1, 1982. This commitment corresponds to the requirements of 10CFR50 Appendix E as amended on September 16, 1981 (46FR46587 published September 21, 1981). Due to circumstances beyond our control, fulfillment of that commit-ment is in jeopardy as a result of a Charlevoix County Board of Commissioners -

Resolution dated November 25, 1981 (copy attached). This resolution effec-tively prohibits the installation of the warning system equipment and manning of the system at the county sheriffs' office.

This resolution and a letter from the Charlevoix County Board of Commissioners requesting a " simple hearing" on the matter with the NRC were mailed to Robert F Burnett, Director, Division of Safeguards, NRC, on December 10, 1981.

Copies of these two documents.were hand delivered to Richard Emch, NRC Project Manager and Brian Grimes, Director of Emergency Preparedness Licensing Branch, Office of Inspection and Enforcement on December 15, 1981. Copies were also telecopied to William L Axelson, NRC Region III on December 17, 1981.

Since the Charlevoix County Sheriff's Office is the assigned warning point, and CP Co has been prohibited from installing any equipment there, installa-tion of the warning system has been stopped.

It is our understandin that the County Board had set December 30, 1981 as the o

date for the meeting with the NRC, but that the NRC is unable to support that date. As a result, it is apparent that immediate resolution of this issue will not be possible.

CP Co has made a concerted effort to meet the February 1, 1982 commitment. All necessary equipment has been received and is ready for installation. Acquisition of 80% of right-of-way permits has been oc1281-0028a142

It'is anticipated that system' installation and testing can be completed within approximately 30 days after this issue is resolved.
