Gentlemen:
e By letter dated July 3,1973, Philadelphia Electric Company (PE) filed an application for a construction permit (CP) to build two nuclear power plants in Lancaster County, Pennsylvania. These plants were designated as the Fulton Generating Station, Units 1 & 2.
On December 29, 1978, PE amended its CP application seeking an adjudica-tory early site suitability review (ESR) of the Fulton site pursuant to 10 CFR 2.101 (a-1) and Subpart F to Part 2 of the Commission's regulations.
By letter dated December 5, 1980, the law firm of flunton and Williams, on behalf of PE, requested withdrawal of the CP application for Fulton Units 1
& 2, including its request for an early site suitability review, with the Atomic Safety and Licensing Board Panel (ASLBP).
By order dated February 27, 1981, the ASLBP dismissed the proceeding. On flovember 17, 1981, the Atomic Safety and Licensing Appeal Panel vacated the ASLBP dismissal and remanded the reatter to the ASLBP for further action.
Based on the Appeal Panel decision, the request for withdrawal of the CP application is still pending. !!evertheless, based on established guidelines concerning the assessment of fees for withdrawn applications, we have reviewed th9 actual costs incurred by the various program offices from tia date the appitcation was filed to February 27, 1981. The costs expended for the review of Fulton 1 and 2 are approximately $355,000. We intend to bill Philadelphia Electric for the cost of the review, less the application fee paid, as soon as the ASLBP takes further action on the case.
