This is to outline for the Eoard the linited role which tbc Staff plans to take in the upconing proceedings in the captioned ratter.

When the issue of sunnary disposition was first raised by the Florida Cities, the Staff advised the Licensing Board in a letter dated Aurjust 4,1981 that,

"... the Staff plans to linit its role in any future proceedings to issues which go beyond the dispute between the two parties whose differences were not resolved by the settlenent."

In this recard, the recent !'cnorandon and Order issued by the Licensing Board has the potential for raising issues which go beyond tre dispute between the non-settling parties. These potential issues involve the application of the principles of collateral estoppel to imC proceedings, and the role that the accepted license conditions play with respect to the deternination to be cade by this Licensing Board and the inposition of any nroposed license conditions.
