Dear Administrative Judges:
Enclosed please find the affidavits of Richard Goddard, Esq. and Calvin Moon of the NRC prepared pursuant to this Board's December 8, 1981 Order. Also enclosed is a December 8,1981 letter from Myron Cherry to Richard Goddard of this office containing a copy of an affidavit the former intended to file in this matter. As mentioned in his affidavit, Mr. Goddard was telphoned by both Mr. Cherry and Phillip Steptoe, Esq., one of the attorneys for the Applicant, concerning this Board's December 8 Order.
In addition to contacting Mr. Goddard, Mr. Cherry telephoned Staff affiant, Calvin Moon, regarding the same subject and subsequently notified the undersigned of this fact.
Messrs. Moon and Goddard are no longer involved on behalf of the Staff in this proceeding. The statements contained in their affidavits reflect their best recollection of the meeting in question and should not be construed as representing a Staff position on the merits of the pending.
