Gentlemen:

Subject: Emergency Preparedness App , sal

To verify that licensees have attained an adequate state of onsite e;nergency

preparedness the Office of Inspection and Enforcement is conducting special

appraisals at each operating power reactor si.te.

The objectives of the. appraisal

at each facility are to evaluate the overall adequacy and effectiveness of

emergency preparedness and to identi fy areas of weakness that need to be

strengthened. We will use the findings from these appraisals as a basis not only

for requesting individual licensee action to correct deficiencies but also for

effecting improvements in NRC requirements and guidance.

The NRC conducted a special appraisal of the emergency prepareaness program at

the Browns Ferry Nuclear Plant from July 13 to July 24, 1981. This appraisal was

performed in lieu of certain routine inspectior.s norn. ally conducted in the area.

of emergency preparednen- Amas examined during this appraisal are described in

the enclosed report 6 0-259/81 D D-260/81-19; 50-296/81-19). Within there

areas, the appraisal team reviewed ~ selected procedures and representative

records, observed work practices, and interviewed personnel .

Certain activities under your license appear not to have been conducted in full

compliance with NRC requirements. These items and references to the pertinent

requirements are listed in the Notice of Violation enclosed herewith as

Appendix A.

Elements to be included -in your response to these items are

delineated in the Notice of Violation.

The findings of this emergency

preparedness appraisal also indicate that certain deficiencies exist in your

. emergency preparedness program and .that there are other additional emergency

preparedness areas that you should evaluate and consider for improvement. These

The areas to evaluate and consider for improvement are addressed

in Appendix C, " Appraisal Improvement Items".

We recognize that an explicit regulatory requirement pertaining to each item

identified in Appendices B and C may not currently exist. Notwithstanding this,

you are requested to submit a written statement within thirty (30) days of the

date of this letter, describing your planned actions for correcting each of ti.e

deficiencies identified in Appendix B and the results of your consideration of

the additional items identified for improvement in Appendix C.

This description

is to include (1) steps which have been taken, (2) steps which will be taken, and

(3) a schedule for completion of actions for each item.

This request is made

pursuant to Section 50.54(f) of Part 50, Title 10, Code of Federal Regulations.

Your corrective 'ctions are to be incorporated into the site emergency plan and

procedures as a;propriate.

With respect to the deficiencies identified in Appendix B, and in reference to a

telephone conversation on October 30 between Mr. M. Wisenberg of your staff and

Mr. R. C. Lewis of this office, it is our understanding that corrective actions

will be completed no later than: February 1, 1982 for Deficiency 1; May 1, 1982

for Deficiency 2; and January 1,1982 for Deficiencies 3a and b.

You are requested to inform this office upon the actual completion of each of

these deficiencies.

If the above dates are not met, you are reminded that

enforcement action will be considered.

In accordance with 10 CFR 2.790 of the Commission's regulations, a copy of this

letter and the enclosures will be placed in the NRC's Public Document Room.

If

the report contains any information that you believe to be exempt from disclosure

under 10 CFR 9.5(a)(4), it is necessary that you:

(a) notify this office by

telephone within ten days from the date of this letter of your intention to file

a request for withholding; and (b) submit within twenty-five days from the date

of this letter a written application to this office to withhold such information.

If your receipt of this letter has been delayed such that less than seven days

are available for your review, please notify this office promptly so that a new

due date may be established. Consistent with section 2.790(b)(1), such applica-

tion must be accompanied by an affidavit executed by the owner of the information

which identifies the document or part thereof sought to be withheld, and a full

statement of the reasons on the basis of which it is claimed that the information

should be withheld from public disclosure.

This section further requires the

statement to address with specificity the considerations listed in 10 CFR 2.790(b)(4). The information sought to be withheld shall be incorporated as far

as possible into a separate part of the affidavit.

If we do not hear from you in

this regard within the specified periods noted above, the report will be placed

in the Public Document Room.

The responses directed by this letter and the accompanying Notice are not subject

to the clearance procedures of the Office of Management and Budget as required by

the Paperwork Reduction Act of 1980, PL 96-511.
